PersonaSend is built for legitimate, personal email communication. It is not a platform for spam, phishing, fraud, harassment or abusive mass outreach.

This Spam and Acceptable Email Use Policy applies to everyone who uses PersonaSend. It forms part of our Terms of Service.

1. Your responsibility as the sender

You, not PersonaSend, choose your recipients and send the messages from your account. Emails go out from your own connected inboxes, under your name.

You are responsible for making sure your email activity complies with all laws and regulations that apply to you and your recipients, such as the CAN-SPAM Act in the United States, the GDPR and ePrivacy rules in the European Union and the United Kingdom, and CASL in Canada.

The fact that PersonaSend technically lets you write or send a message does not mean that the message is lawful or allowed.

2. Prohibited email practices

You must not use PersonaSend to:

  • send unlawful spam;
  • run phishing campaigns, or obtain passwords, financial information, login codes or credentials through deception;
  • use false or misleading sender information, or deceptive subject lines;
  • impersonate another person or organization without authorization;
  • send fraudulent offers or deceptive requests;
  • use unlawfully obtained, harvested, scraped, purchased, rented or stolen email addresses;
  • deliberately email addresses that have opted out where the law requires you to honor that opt-out;
  • hide who you are where the law requires you to say;
  • get around unsubscribe or suppression lists;
  • distribute malware or malicious links;
  • repeatedly contact people to harass them;
  • cause excessive complaint or bounce rates;
  • get around account restrictions, sending limits or abuse controls; or
  • create new accounts to continue activity for which another account was suspended.

3. Commercial email requirements

If you use PersonaSend for commercial email, you are responsible for meeting the legal requirements that apply to it.

Depending on the country and situation, these may include rules about identifying the sender, truthful subject lines, saying that a message is an advertisement, including a postal address, having consent or another lawful basis, offering an unsubscribe option, and acting on opt-out requests on time.

4. Recipient lists

You are responsible for where your recipient information comes from and for your right to use it. Write to people who would reasonably expect to hear from you, for example because of a genuine business reason related to their role.

PersonaSend may restrict the use of lists obtained through scraping, harvesting, buying, theft, unauthorized disclosure or other sources that create unacceptable legal, privacy or deliverability risks.

5. Unsubscribe requests

Where an unsubscribe or opt-out right applies, you must provide it and honor it as the law requires.

You must not remove, hide, disable or get around the unsubscribe link and the mailing address that PersonaSend adds to your emails in order to avoid legal requirements.

6. What PersonaSend does to help

These tools help you send responsibly. They do not replace your own legal obligations.

  • Every campaign email gets an unsubscribe link and a one-click unsubscribe option that email apps like Gmail show next to the sender.
  • Your mailing address is added under the unsubscribe line of every campaign email.
  • People who unsubscribe, and addresses known to have bounced, are put on your suppression list and are not emailed again.
  • Each connected inbox sends at most 50 emails a day, with natural gaps between emails, to protect your reputation and your recipients.
  • Free email checks help you remove addresses that can't receive mail before you send.
  • You see and can edit every AI draft before a campaign goes out.

7. Enforcement

PersonaSend may investigate suspected abuse, including by reviewing campaign content and contact lists.

Depending on how serious the activity is, we may:

  • warn the account holder;
  • pause campaigns or restrict sending;
  • ask for more verification;
  • temporarily suspend the account;
  • permanently close the account;
  • block linked accounts or payment methods where reasonably necessary to prevent the rules from being dodged; or
  • keep or disclose information when required or allowed by law.

Serious misconduct, including phishing, fraud, malware, deliberately dodging enforcement, or similarly harmful activity, may lead to immediate termination without warning.

Services already used are generally not refundable after termination for a material policy violation, subject to applicable law. See our Refund Policy.

8. Reporting abuse

If you received abusive or suspicious email that you believe was sent with PersonaSend, please tell us:

Please include the email you received, with its full headers if you can (in Gmail: open the email, click the three dots, then "Show original"), and anything else that can help us investigate.

To stop receiving emails from that sender straight away, use the unsubscribe link at the bottom of their email.

We take genuine abuse reports seriously and look at urgent reports within one business day.
